Service Agreement Terms
If you are choosing to work with us, we ask that you read and acknowledge the terms below.
Commencement of work is considered a contractual agreement.
The Book Editor's Service Agreement Terms
*The Project may include any and all content subjected to the Editor’s input, and includes written and verbal consultation. The Project scope can include any work done by the Editor and is not limited to items mentioned in the Service Agreement.
The Client and the Editor, as specified above, acknowledge and agree on the following terms:
-
The Client is solely responsible for the final product, as the services of the Editor can be considered purely consultative. Any and all changes and recommendations may be rejected by the Client.
-
The Editor does not guarantee sales or project success in any form.
-
The Client has full control over the final manuscript(s). If any work done by the Editor is not up to the desired standards, it must be disputed within seven (7) days of exchange.
-
The Client understands that the nature of editing is largely subjective, and the Client reserves the right to discuss or disagree with edits and opinions of the Editor. It is understood by the Client that disagreements over comments and opinions do not negate invoices for time spent on the Project by the Editor, although client dissatisfaction will be considered in seeking a resolution.
-
The Client acknowledges that while the objective of editing and proofreading services is to eliminate typographical errors and mistakes, a 100% error-free result cannot be guaranteed. The likelihood of remaining errors is influenced by the extent of work performed and the scope of the services selected. The process is considered a collaborative effort between Editor and Client to achieve a professional outcome, and it is always recommended that the Client thoroughly reviews the completed work.
-
The Client understands that any expectations of project cost are, unless explicitly stated, only an estimate, not a quote. The Client understands that the price estimate is based on certain assumptions and expectations, and should not be expected to be exact. If there is a strict budget for the Project, it is the responsibility of the Client to communicate this clearly to the Editor.
-
If the Client is dissatisfied with the Project quality as a result of the work done by the Editor, the Client must communicate the issues in full to the Editor with the intention of seeking a resolution. If no resolution can be agreed on, the Client must settle all outstanding balances at the rate agreed to in the Service Agreement.
-
The Client is solely responsible for ensuring the Editor is provided with all necessary information and project stipulations, and that all special requirements for the Project are understood explicitly by all involved parties. All information must be given in writing before work commences. This information can include, but is not limited to, budget limitations, language and/or style guide to be used, target readership, project targets, expected or required project turnaround, and the involvement of other parties contributing to the Project.
-
All invoices submitted by the Editor must be paid before the due date specified on the invoice. If payment is not received by the specified due date, the Client may be charged with an additional late-payment fee of up to 20% (twenty per cent) of the late invoice’s total, and the Editor may discontinue work until the invoice has been paid in full. If non-payment becomes recurrent, the Editor may refuse further work for the Client.
-
Phone calls, emails and/or meetings between the Client and the Editor may be accounted for and invoiced for in hourly work rates if the Editor deems it to be of a valuable consultative nature, and/or if session time exceeds fifteen (15) minutes. Travel and preparation time may be invoiced for.
-
The Editor will not disclose any manuscripts, written content, or private information belonging to or produced by the Client to any third party without the Client’s prior consent.
-
The Client will retain the exclusive copyright of the manuscript and illustrations. The Editor shall have no copyright claim or interest in the Client’s manuscript and/or illustration.
-
The Client is solely liable for any plagiarism, libel, or copyright infringements. It is up to the Client to ensure that the manuscript adheres to all legal protocol and requirements.
-
The Client is solely responsible for the accuracy of details, such as names, dates and locations, as well as the spelling and grammar of any text in a non-English language.
-
The Editor shall not use any IP or unique elements of the Project for any reason whatsoever without the Client’s prior written consent (which may be withheld at the Client’s sole discretion).
-
If the Client wants to pause or cancel the service, the Client must provide a written statement to the Editor and settle all outstanding balances.
-
If work requested by the Client is considered urgent or is to be prioritised over other clients, a surcharge of up to 20% may be included in the invoice.
-
These terms extend to any and all work done for the Client by the Editor, including work outside of the aforementioned Project. Any changes to these terms, including updated hourly rates, will be communicated to the client, and may be stipulated in a new Service Agreement. Choosing to proceed will be considered as an agreement to the terms.
